Child born in the UK - British 🇬🇧 or not?



This is one of our most popular posts of all times: child born in the UK, does he get British Citizenship? This updated post was partly inspired by the Guardian article about 100,000 of undocumented children in London. If you are interested in that subject, of how a child’s status can be legalised, you can read on our blog here

In this message we are considering more common situations when a child is born in the UK to migrant parents. 

Child born in the UK:

A child born in the UK is not automatically British since the law was changed in 1983. Instead, their status is based on the parents' status:

- If a parent is British, then a child is British by birth. 
- If a parent has settled status, such as Indefinite Leave, then a child is British by birth. 
- European citizens gain settled status automatically, which may be earlier than the date of Settlement Scheme registration, in this case please contact us. 

If, however, a parent is not settled but settles later after the child’s birth, then a child can be registered as British. 
A child doesn’t even need Indefinite Leave, saving the family a hefty Government fee. 

Child born outside the UK: 

In this scenario, a child can only become British when he/she gains a settled status ion the UK and the parent(s) become settled with at least one parent becoming a British Citizen. For example, if a family are on Tier 2 and Tier 2 Dependant visas, they can all apply together for Citizenship one year after they all have secured Indefinite Leave.

👨‍👩‍👦 The Guardian article: 100,000 undocumented children in London. How can children settle and become British?



According to the article here, there are 100,000 children in London 'without secure immigration status’. In other words, 100,000 children living in London illegally, without a UK visa, settlement or British Citizenship. 


Why can a child be without immigration status? 

Many were actually born in the UK while their parent(s) had no status themselves, and found it difficult or expensive to apply for it.

Many other youngsters were brought to the UK at a young age by their families who since made the UK their home. For example, by coming here on a visitor visa and remaining as what we call ‘overstayers’. 


What are the solutions? 

First of all, it becomes harder and more expensive to secure an immigration status once a child turns 18 years old. Wherever possible, it’s best dealt with before the 18th birthday. 


Child born in the UK:

A child born in the UK is not automatically British since the law changed in 1983. Instead, their status is based on the parents' status. If a parent is British, then a child is British by birth. If a parent has settled status, such as Indefinite Leave, then a child is British by birth.

If, however, a parent is not settled but settles later after the child’s birth, then a child can be registered as British. 
This is where The Guardian correctly pointed out at the £1,012 cost of such an application! 

A child, who was born in the UK and lived here for the first 10 years of his life, can also be registered as British, also at the above fee, even though the High Court recently found that the Home Office’s £1,012 child citizenship fee to be unlawful. 

Both actions can only be done before the child turns 18 years old!  


Child born outside the UK: 

In this scenario, a child can only become British when he/she gains a settled status ion the UK and the parent(s) become settled with at least one parent becoming a British Citizen. Not easy if the parents are also here without a legal status; or with the expensive Government fees. In this case, a child can apply for a leave to remain under Private Life after he/she has lived in the UK for 7 years (if aged under 18). If a child is aged between 18 and 25, and spent a half of his life in the UK, can also qualify. The outcome is a visa for 2.5 years. Only after 3 extension and 10 years of legal  residence can one apply for settlement. Then for Citizenship.

👫 Civil partnership law change: how does it affect visas?



Recent law change made it possible for all couples to register a civil partnership. 

How does it affect UK visa process? Civil partners have always had the same visa rights as married couples. The difference was in family law: in the past only same-sex couples could enter a civil partnership. Now all couples have a choice of getting married or entering a civil partnership (or not doing either). Interestingly, same-sex couples campaigned for the right to get married. Then opposite-sex couples campaigned for the right ... not to get married. Fortunately, now it’s all aligned! 

What’s the difference? Civil partnerships have the same benefits as marriages when it comes to tax, benefits, pension, parental rights, property, inheritance etc. They also the same procedure if the couple wants to part their way (except can’t “blame” on adultery). 

They differ in not having religious or cultural attachments: no church ceremony, no vows etc. There is also different legal terminology (dissolution instead of divorce, for example) but generally, the difference is more psychological than practical. 

In terms of a UK visa, the only “unmarried" alternative remains an Unmarried Partner visa. As before, it is available to all couples who have lived together in a relationship for 2 years – and who are able to prove it with strict specified evidence, which is often a challenge. Now, there are 3 options for all, plus a Fiancee visa.

🎓 Return of UK Post-Study Visa


Since we entered 2020, this is one of the most common questions: Return of post-study work visa.

This visa category was very popular until its closure in 2012. There are now plans to revive it for foreign students (EU and non-EU) who begin a degree course during 2020/21 intake at UK universities (but not to those who are already studying here now). There are no further details yet, but if it is based on the past, graduates would be able to stay in the UK for 2 years with the right to work. It won’t lead to Settlement but 2 years could be enough to find sponsorship for a work visa. Or to set up a business. Or qualify as a parter of a UK citizen under Unmarried Partner category that requires 2 years of living together.
