This is one of our most popular posts of all times: child born in the UK, does he get British Citizenship?   This updated post was partly inspired by the Guardian article about 100,000 of undocumented children in London.  If you are interested in that subject, of how a child’s status can be legalised, you can read on our blog here .  In this message we are considering more common situations when a child is born in the UK to migrant parents.  Child born in the UK: A child born in the UK is not automatically British since the law was changed in 1983. 👨‍👩‍👦 The Guardian article: 100,000 undocumented children in London. How can children settle and become British?

According to the article here,  there are 100,000 children in London  'without secure immigration status’.  In other words, 100,000 children living in London illegally, without a UK visa, settlement or British Citizenship.  Why can a child be without immigration status?   Many were actually born in the UK while their parent(s) had no status themselves, and found it difficult or expensive to apply for it. Recent law change made it possible for all couples to register a civil partnership.  How does it affect UK visa process? Civil partners have always had the same visa rights as married couples. The difference was in family law: in the past only same-sex couples could enter a civil partnership. Now all couples have a choice of getting married or entering a civil partnership (or not doing either). Interestingly, same-sex couples campaigned for the right to get married. Then opposite-sex couples campaigned for the right ... not to get married. Fortunately, now it’s all aligned!  What’s the difference? Since we entered 2020, this is one of the most common questions: Return of post-study work visa. This visa category was very popular until its closure in 2012. There are now plans to revive it for foreign students (EU and non-EU) who begin a degree course during 2020/21 intake at UK universities (but not to those who are already studying here now). There are no further details yet, but if it is based on the past, graduates would be able to stay in the UK for 2 years with the right to work. It won’t lead to Settlement but 2 years could be enough to find sponsorship for a work visa. Or to set up a business.
