Visa rules - before and after Brexit.





We have decided to sum up the Government Brexit visa proposals, that is what they disclosed so far.  We were prompted to make this table by a recent Daily Mail article  



EU citizens until 31.12.2020
(based on Government publication here)


EU and non-EU citizens after 31.12.2018 (based on the proposals so far)
Who can come and work in the UK? Skilled and unskilled workers Can come and work in the UK without restrictions.
Only skilled workers and only when sponsored by a UK employer (employers have to go through vigorous tests on ‘genuineness’).

Low-skilled workers aren’t allowed in.


Skilled workers will still have to be sponsored by UK employers.

Low-skilled workers from ‘low risk’ countries will be allowed to work for up to 12 months.

What is meant by a skilled worker? N/A Jobs at a ‘degree level’ NQF 6 from the ONS which was included in the Immigration Rules here . Jobs at NQF Level 4 which is presumed to be ‘A Level’ jobs (which happened to be the same rule as pre-2014 anyway).
Does it lead to settlement and UK passport? Yes. Yes. Yes for skilled workers. No for the unskilled.

Minimum salary
No rules other than UK minimum wage. £30,000 unless falls for exemptions, such as fresh graduates, where the minimum is £21,000. There will be some minimum to ensure foreign workers are offered the same pay as UK workers (to prevent ‘cheap labour’) but a consultation is to be held on the level.

Minimum salary to qualify for settlement
No rules other than UK minimum wage.
£35,500 for 2018-19, increasing slightly every year. Unless exempt, such as nurses.


To be confirmed.
Do employers have to consider UK workers first?
No, in fact the EU law specifically prohibits to discriminate EU workers.


Yes, have to advertise a job and try to find a settled worker first. Unless exempt, such a when sponsoring fresh graduates.


So far, the proposal is to make it easier for employers and
not to force employers to do this anymore.
Limit on the number of visas? No. Those coming from outside the UK/EU are limited to 20,700 per year. But there is no limit on migrants already in the UK, such as fresh graduates. So far, the proposal is not to have a limit.
Benefits
In many cases, can claim benefits in the same way as UK citizens can, including child benefit



Cannot claim benefits (including child benefit) until securing settlement after 5 years of working.



So far, the plan is not to allow claiming benefits until securing settlement.



NHS
Can use the NHS free of charge.


Can use the NHS but have to pay £200 per year (and same per each family member including a child) when applying for a visa. The NHS rules are to be confirmed but expected to be the same as for non-EU citizens now.
Criminal convictions

Depending on the severity of the offence, some are prevented from securing a visa altogether while others are prevented from settlement and UK passport until 2-3 years after the conviction. To be confirmed but expected to be the same as for non-EU citizens now.

When to apply for British Citizenship?



 It’s the ultimate goal for any foreign citizen coming to the UK – the British passport!
The journey may take time and money but it is well worth it! You may be just at the beginning of your ‘journey’, such as having your 1st UK visa, or you may be already on the way to Indefinite Leave. It is never too early to find out your rights and make a plan for the future.

Here is our short 5-point summary to get you started.

#1 Spouses of British citizens:
The process is initial Spouse visa (30 or 33 months), then extension for further 30 months, then permanent residency after 5 years. You can apply for British Citizenship straight after that. Most common mistake: applying after 3 years of residency in the UK.

#2 European citizens and family members:
Firstly, you need to acquire a permanent residency status, usually after 5 years in the UK. Then you can apply for Citizenship 1 year after you have qualified for the PR. Even if your PR document was issued later, you can still apply for Citizenship 1 year after you ‘qualified’ for it. Most common mistakes: miscalculating eligibility for PR, unnecessarily waiting for 1 year after the date on PR.

#3 If you already have Indefinite Leave or Permanent Residency document:
You are only 1 step away from Citizenship! If you have a PR under the UK law (usually called
Indefinite Leave), you need to wait for 12 months after the date on it unless you are married to a UK citizen. If you have a PR document under the European law (usually has words “Permanent Residency”), you can apply 12 months after you have qualified for it, which can be years back.

#4 If you have a visa that leads to Permanent Residency:
You are getting there! There are some UK visa categories that lead to settlement, such as Tier 2 General, Tier 1 Entrepreneur, PBS Dependant or Spouse/Partner visa. In this case, you need to wait until you can qualify for permanent residency and then apply for Citizenship as above.

 #5 If you have a visa that doesn’t lead to Permanent Residency:
Your journey is going to be the longest! Examples of categories that don’t lead to settlement: Tier 4 student visa, Tier 2 ICT, Tier 1 (Graduate Entrepreneur), Tier 5. Firstly, you need to switch to a visa category that leads to settlement, then wait for 5 years (in most cases) on those visas to secure permanent residency and then apply for Citizenship.

Christmas Wishes And Festive Break 21 December - 3 January

2018 has almost gone by and what an eventful year it has been! A lot happened in the immigration world. We have been very busy, helping 100s of customers to navigate the maze of regulations, Brexit rules, and successfully securing their visas.

Festive working hours:
Our office will be closed from Friday 21st December 2018 (i.e. last office day will be Thursday 20th December) and back to normal on Thursday 3rd January 2019. 

If you would like your visa application to be prepared before 20th December, please let us have the required information/documents as soon as possible!

Tier 1 business plan customers:
The business department will continue to work throughout the festive period.

Schengen visas:
 We strongly recommend to apply as soon as possible before Embassies take a long festive break. Remember, you don’t have to travel to the visa centre and do biometrics again if your last Schengen visa had a VIS stamp, we can handle the whole process for you!

Russian visas:
 Russian national holidays will cover the first week of January 2019. If you are planning a trip to Russia, please apply now unless you are travelling in the 2nd half of January.
