🇬🇧Spouse and Partner visas - 5 or 10-year route? The difference.

Image
5-year route is a standard one. You can qualify for permanent residency after 5 years in the UK. The 1st visa is for 30 months (2.5 years) if you apply inside the UK, such as when switching from a Student, Graduate, Youth Mobility or a work visa. Or for 33 months (2.5 years + 3 months) if you apply outside the UK. Then extension for further 2.5 years, then settlement after 5 years.  10-year route is used when you have serious, exceptional circumstances why you cannot meet the requirements of the standard route. For example, a serious illness or similar family circumstances are preventing you or your partner from meeting the Financial Requirement £18,600. Here the 1st visa is again for 30 months (2.5 years), but you need further 3 extensions until you can settle in the UK after 10 years. There may be better solutions, however, such as switching from the 10 to 5-year route or settling after 10 years on any visas. Can you combine them when counting to settlement? In the 5-year route,

5 common 🇬🇧visa questions about Covid

Image
Here we have rounded up the updated information on the most commonly asked questions about UK visas that are related to Covid disruption, which can also be found here . #1 I had to stay outside the UK during the pandemic, will my (longer than planned) absences affect my next application?  If you left and returned on the same visa, and had to stay abroad because of Covid, your absences wouldn't normally affect your next application. If your visa expired while you were abroad, and you are wondering whether a break between visas will affect your 'continuous residence’. Such as when counting ‘your’ 5 years for Settlement (Indefinite Leave). The answer is: if your visa expired between 1 March 2020 and 19 July 2021, a break of up to 6 months will be accepted.  #2 My income was reduced and/or I was on furlough, how can I meet the Financial Requirement for a Spouse/Partner or family visa in my next application? If your salary has reduced because you were furloughed, you can use income

🇬🇧 What is your status while waiting for a UK visa?

Image
If you have a UK visa and it’s about to expire, you would, normally, submit a new application. Of the same type (extension) or a different type (switching), or for settlement. You can do it up to the last day of visa current visa and it will be 100% legal. So, you applied and waiting for a decision, what is your status? What if your old visa expired during that time? Especially if you indeed apply on the last day. Would you become an overstayer? Do you have to time your application to give the Government enough time to make a decision before your old visa expires? Should you use the more expensive Priority services? The answer is: if you applied while your old visa was still valid (even on the last day), your immigration status automatically extends by law and remains the same for as long as the Government takes to consider your new application . Doesn’t matter whether it would take a day, a few months or a year. Most visa types take 8 weeks while Settlement takes up to 6 months. In ou

🧐 Furlough leave and UK visas

Image
If you have been furloughed, how does it affect your UK immigration status? Here at 1st 4Immigration it has been a common question during 2020.   Spouses/Partners of British citizens - Financial Requirement £18,600. The time you spent on furlough can be considered as ‘normal' employment on a full pay. For example, if you normally earn a salary of £18,600 pa, and were paid 80% of that while on furlough, your salary will be treated as being £18,600 for the purpose of the visa application. Tier 2 (General) workers - appropriate salary. The short answer is Yes, it's OK to be furloughed under the Government scheme, ie Coronavirus Job Retention Scheme, with the salary reduced accordingly. It wouldn't be a problem in the next visa application (extension or Indefinite Leave). The migrant workers are eligible for these schemes in the same way as resident workers. However, such reductions in salary must be temporary and a part of a company-wide policy to avoid redundancies and in whi
