πŸ‡¬πŸ‡§ Can you change a visa without leaving the UK?



Changing from one UK visa type to another is one of the most popular subjects in our immigration work. It is what we call ‘switching', ie changing without leaving the UK.  


Normally, the answer lies in the Immigration Rules for the category you are switching into. For example, until December 2020 the work visa rules didn’t allow switching from most categories. Now, however, it is possible to change from almost (but not all) every UK visa under the post-Brexit Points Based Immigration System.


Other useful examples: 


If you have a Visitor visa, you cannot, normally, switch to a Skilled Worker or a family visa. However, at the moment, it may be possible to do so under Covid-19 concessions, albeit in limited circumstances. You still have to meet the rules, such as having a Sponsor for a work visa, or meeting the Financial Requirement £18,600 for a visa as a spouse/partner of a British citizen, but may be able to secure your status without leaving the UK. If you have a Student visa (or its predecessor Tier 4), you can switch to a Work visa or Spouse/Partner visa. Work visas include the new Graduate route from 1 July 2021, it’s a return of the old Post-Study Work visa and more can be found here. 


If you have a Work visa, you can switch to a Spouse/Partner visa. A popular switch because the latter doesn’t tie you to a job and you can work for any employer (but ties to your relationship). If you have a Graduate visa, it’s a good to switch to Spouse/Partner status ASAP because you could start the 5-year route to settlement. And you can switch other way around, from Spouse/Partner to a Worker, a useful option if the marriage has broken down but there’s a willing employer to sponsor you. This wasn’t possible before December 2020. 


You can also switch from Tier 2 Intra-Company Transfer to the ‘main' Skilled Worker category. This is a long-awaited solution for ICT migrants who, in the past, couldn’t remain in the country beyond 5 years and couldn’t qualify for settlement. 


If you have a Tier 5 YMS visa, you can switch to a Work visa (wasn’t possible until 2021), or go down the well-established route of a Spouse/Partner visa. For many, Tier 5 is another category that gives unmarried partners times to meet the “living together for 2 years” requirement.

#1 Priority visa services are up and running, and are very popular! 

Priority and Super Priority services allow to obtain a visa decision within 5 working days or on the next working day respectively, for an additional Government fee. These are for in-UK applications. Eligible categories are visas for spouses/partners of UK citizens, workers including Skilled Worker and Health and Care Worker visa, Ancestral visa, Long residence 10 years and some business/investment categories. Available when you are switching from another category (Student to Spouse; Student to a Skilled Worker etc), extension in the same category and settlement / Indefinite Leave. #2 Graduate visa started on 1 July 2021.

Great for international students, UK employers looking for graduates. And also for … unmarried partners of UK citizens who cannot (yet) prove 'living together for 2 years’. So, graduates from UK universities can now stay for 2 years in the UK upon completion a degree course. PhD graduates get 3 years. This visa gives time to look for work, for example, and gain experience that may lead to sponsorship under the Skilled Worker visa (formerly Tier 2). It doesn't count or lead to settlement, though, unless for the purpose of ’10 years in the UK’. If you qualify, you can switch from a Student visa straight to a category that does lead to settlement: Skilled Worker, Health and Care Worker, Spouse/Partner of a UK citizen. #3 Health and Care Worker visa. 

This isn't a new category but we’d like to draw attention that the ‘Care Worker’ element is now available. Yes, it may sound strange, a Care Worker visa without allowing carers to apply for it, but this is what it was like until a few months ago. Only ‘Health’ workers were allowed, i.e. nurses, doctors, some scientists etc. Now, it is also available to Senior Care Workers , as well as care managers, to come to the UK (or remain here) to work for a caring establishment, such as a nursing home. As usual under this category, they need sponsorship from a UK licensed employer, i.e. the NHS, care company and so on. There are also welcome concessions on salary and lower Government fees compared to the standard rules (and points) of a Skilled Worker visa. All eligible jobs can be found here.

This is one of our most popular posts of all times: child born in the UK, does he get British Citizenship? This updated post was partly inspired by the Guardian article about 100,000 of undocumented children in London. If you are interested in that subject, of how a child’s status can be legalised, you can read on our blog here


In this message we are considering more common situations when a child is born in the UK to migrant parents. 


Child born in the UK:


A child born in the UK is not automatically British since the law was changed in 1983. Instead, their status is based on the parents' status:


- If a parent is British, then a child is British by birth. 

- If a parent has settled status, such as Indefinite Leave, then a child is British by birth. 

- European citizens gain settled status automatically, which may be earlier than the date of Settlement Scheme registration, in this case please contact us. 


If, however, a parent is not settled but settles later after the child’s birth, then a child can be registered as British. 

A child doesn’t even need Indefinite Leave, saving the family a hefty Government fee. 


Child born outside the UK: 


In this scenario, a child can only become British when he/she gains a settled status ion the UK and the parent(s) become settled with at least one parent becoming a British Citizen. For example, if a family are on Skilled Worker and Skilled Worker Dependant visas, they can all apply together for Citizenship one year after they all have secured Indefinite Leave.

Graduate visa has finally opened on 1 July 2021! Those of us working in immigration law for a long time still call it by its predecessor, Post-Study Work visa. International students, who are in the UK on a Tier 4 or Student visa, can remain for 2 years after completing their course (3 years for PhD graduates). 


The highlights:


#1 Graduate visa allows to work in the UK in almost any job. No need for sponsorship (no job offer is needed), no minimum salary, no limit on places etc. 


#2 You can apply once your university has confirmed a successful completion of your course. You cannot apply before that (such as while waiting for the results) but don’t have to wait for the formal graduation either. Qualifying courses are Bachelor, Master, PhD but also some professional courses, please contact us for details.  


#3 You can only apply inside the UK, i.e. switch from a Student visa. 


#4 Digital application process with an eVisa. The immigration process has been moving onto a digital domain for some time now, and this new category will be a digital one from the start. In most cases, you’d need an app to confirm your ID, and if it's not possible, then you might need to attend a visa centre. Your eVisa will also be a proof of your status in the UK and accessible by other UK Government departments, such as the NHS. 


#5 This is an interesting one. Dependants can only join (ie get a Graduate Dependant visa) if they already had a Tier 4 /Student Dependant visa while you were studying. But no new dependants are allowed while you are on a Graduate visa, you can only add them later, such as when you switch to a Skilled Worker visa. There are some finer details, such as children born in the UK, please contact us for details. 


#6 This visa doesn’t count towards settlement in the standard 5-year routes. You don’t have to have it, though, you can ‘jump’ straight to a visa that does lead to settlement, such as straight to a Skilled Worker visa (formerly Tier 2 General) if you are able to secure sponsorship from a UK employer. If you are studying for a degree in medical or certain science disciplines, you can apply for a Health and Care Worker visa, which is a part of a Skilled Worker visa and leads to settlement, plus has lower fees. Likewise, if you qualify for a Spouse/Partner visa on the basis of your relationship with a UK citizen. In fact, this visa is the answer for many couples who aren’t married and cannot qualify for an Unmarried Partner visa (haven’t lived together for 2 years), so this visa will allow time for that!
