We do not read Romanian ourselves but trust the above is positive! Loredana came to us enquiring about British Citizenship, having lived, studied and worked in the UK for more than 6 years. She started exercising Treaty rights from taking a course at a UK university. She also did not buy private medical insurance (aka comprehensive medical insurance) while studying, same most EU nationals did not at the time.

The Rules were changed later, on 20 June 2011, requiring the  EU students to have this medical insurance for any time spent studying in the UK, even for those who studied before the new Rules were introduced (most unusual and unfair but it is how it works, unfortunately). In this case, however, we could use the Transitional Arrangements for students: since our client had applied for a Yellow Card while studying (because she wanted to work part-time), she had her status confirmed and therefore, did not need to show she had medical insurance.

Having graduated, our client has been working for a few companies in the UK. She was also worried that she did not have evidence from every single job. We advised to contact HMRC and obtain employment history, which is a list of all employments in one paper. That, together with the  available evidence like work contracts and available payslips, worked well. Then we added a Life in the UK test and a degree certificate from the degree which was also used for exercising treaty rights.

Kelly arrived in the UK from France about a year before making this application. She had a Tier 2 Intra-Company Transfer Entry Clearance issued in France where the couple resided together since 2010. But the main benefit in our opinion is, although more expensive, it allows the applicant to know result right on the day, including if there are any problems, rather than waiting for months with postal service and then possibly being told there is a problem or even that application has been refused.

2nd valid passport for frequent business travellers: this is possible within the timing of normal urgent services, here your employer has to provide a letter confirming you have to travel frequently for work and you need a 2nd passport  to travel while your 1st one is used to apply for visas.

New successful case and testimonial on a Spouse Entry Clearance. Financial Requirement £18,600 was met via self-employment in the UK in the last tax year.

This came from James, a British citizen whose wife was applying in Japan. James, who is self-employed as a sole trader in the UK, was able to meet the Financial Requirement of £18,600 once his tax return was submitted for the tax year 2012-13. HMRC Tax Calculation (SA302 form) was showing profit of self-employment of just over £19,000.

With self-employed people the £18,600 threshold is based on profit from self-employment, not turnover, ie not what the business received from the customers. It is based on the profit, which is the difference between turnover and expenses, before taxes. Furthermore, it is based on the last full financial year, in case of sole traders it is a UK tax year. If one registered as self-employed in the middle of a tax year he/she would have to wait until tax year is ended and a tax returned submitted and confirmed by HMRC.

Those who have limited companies have to use a different approach. We have extensive experience in dealing with either sole traders or company owners.

Another thing was the UKVI (former UK Border Agency) required business accounts prepared by a professional accountant.  Small businesses don’t have to prepare audited accounts, and for HMRC don’t have to prepare unaudited accounts either. However, for a visa application our client had to ask a professional accountant to prepare financial statements (‘accounts’) because it was one of the ‘Specified Evidence’ under Appendix FM-SE. Even though this is not a requirement for tax purposes, it is a requirement for a visa application and therefore needs to be done ‘because it is a rule’.
