Kelly
arrived in the UK from France about a year before making this application. She had
a Tier 2 Intra-Company Transfer Entry Clearance issued in France where the
couple resided together since 2010. Kelly applied for a Tier 2 visa, as opposed
to an EEA Family Permit, on insistence of her employer.
A year after
arrival in the UK Kelly approached us about applying for an EEA Residence Card,
so she could have a freedom of working in the UK for any employer.
The
application was based on the couple’s ‘durable relationship’, similar to that
for Unmarried Partners under the UK Immigration Rules (but this application was
under the EU law). Kelly and her French partner resided in the UK for the last
year and had sufficient documents. The other year was from the couple’s time
spent in France, so the documents (bills, bank statements etc) were in French
and we also helped to arrange translations.
We submitted
an EEA2 application and it was granted after 3 months.
