Indefinite Leave to Remain, the term ‘Settlement’ and 2 confusing meanings of it.

There are 2 meanings of a term ‘Settlement’ when it comes to the UK visas. This is why it can be confusing to understand the Immigration Rules. Meaning #1: Permanent Residency in the UK, known as Indefinite Leave to Remain (ILR). The Rules, the visa officers and therefore immigration lawyers often say “Apply for Settlement “ or “Apply to settle in the UK”, you can see here on UKVI website: https://www.gov.uk/settle-in-the-uk Even ILR application forms have names like SET(M) or SET(O). Meaning #2: when spouses, partners and fiancées are applying from outside the UK, such applications are also called ‘Settlement’. It does not mean these are applications for Permanent Residency but means that the applicant (a foreign partner) is planning to come to the UK with the view of settling here, ie ‘for settlement’.  There is no such term when switching from a Spouse/Partner visa inside the UK, for example, from a Tier 4 to a Spouse visa. How long can a visitor stay in the UK? 6 months... but how is it calculated? 6 months in a year or from each entry?

This has been one of the most commonly asked question during our 10 years of practice, so this is an updated post. If you saw our old post from 2013, saying “6 months in each year” rule, it is now out of date and the current guidance is very different. So, the updated rule on the date of this post (February 2018) is that 6 months stay starts from the date of each entry in the UK, ie from the airport stamp. You can come and go, and every time you come back “your” 6 months start again. If you aren’t required to have a visa stamp before travelling, you would get a stamp on arrival at the airport. If you are a visa national (ie need to have a visa stamp before coming to the UK), your visitor visa has to be long enough, such as for 2, 5 or even 10 years. If your visa stamp is only for 6 months and you entered, say, 1 month after it was issued, you’d have only 5 months left to stay in the UK and you can actually extend your visa to give you that extra 1 month (will be expensive bu

10 Common Mistakes - Financial Requirement for UK Spouse Visa - #5 misunderstanding Category B (again) and waiting unnecessarily for 12 months.

For some reason, it is Category B that seems to be causing most of the problems we see applicants make. If you changed your job and can’t apply under Category A because you haven’t worked for your new (ie current) employer for 6 months yet, you’d have to use Category B. The 1st part would be your current salary being £18600 per year. The 2nd part is total earnings for the last 12 months in both current and previous jobs.  Or several previous jobs, as you can combine any number of jobs in the 12 months prior to the visa application. The question is: do you actually have to have worked for the whole 12 months before applying? Or to wait for the whole 12 months if you didn’t work that long? The answer is No - if you can meet the total £18600 in earnings in a shorter period than 12 months. Of course, you need a salary much higher than £18600! For example, if you only worked for 5 months for Employer 1 and then for 1 month for the current Employer 2 but your salary has been, say,
