Children born in the UK: do they need a visa? Or do they become British Citizens?

Our most popular post ever!  A child born in the UK does NOT automatically become British (unlike America). Instead, it depends on child's parents status on the date of birth . 1) If child's parent (one or both) is British, then the child will be a British citizen too. 2) If child's parent (one or both) is not British but has permanent residency in the UK, ie holds Indefinite Leave to Remain or Permanent Residency under European law, then the child will be British also (even if both parents aren't British). In case of European citizen parents, it doesn’t need to be a formal PR document on the child’s birth date, it is sufficient to have qualified for it and apply later.   3) If the child's parents are both not permanent residents and hold visas, such as Tier 1, Tier 2 etc, then the child will NOT be British, even though it was born in the UK. In such a case a child can be given a dependent visa on his/her parents’. This can be done as a sep

European and worried about Brexit? Apply now to have a British passport by March 2019.

The UK Government is working hard to reassure the European citizens in the UK about their rights after Brexit, the latest Statement can be found here: https://www.gov.uk/guidance/status-of-eu-nationals-in-the-uk-what-you-need-to-know One main point there, and something our audience often point out, that there is no need to apply for residency now (such as for a document certifying permanent residence in the UK under the EU law), as there will be a new system after Brexit. A new system to register EU / EEA nationals and bring them in line with the post-Brexit rules, ie transfer their rights onto the UK national law. We have been advising to make an application for permanent residence because you could then make an application to become a British Citizen. Once you are British, it won’t matter what the new system will be. – you will be “safe” anyway. The cost of permanent residence application is currently only £65 in governent fees, the amount is still dictated/cappe

Unmarried Partner Visa - why so difficult?

This is one of the most popular enquiries in our practice. Yet the number of enquiries that we advise to progress to an application is fairly low - but that number is successful in securing a visa with our assistance. The remaining clients are advised to get married and apply for either a Spouse or a Fiancée visa,   here is the page about comparison between them.  Generally, with all applicants out there , this category does have a high number of refused (unsuccessful) visa applications because of the above reason - you have to qualify precisely for this category in order to be successful. Why so? Unmarried Partner visa is not a substitute for a Spouse or a Fiancé(e) visa. It has 2 criteria on the relationship: Firstly , it is a visa for those who have lived together in a relationship akin to marriage for at least 2 years. Not dated, not visited each other, but actually lived together for minimum of 2 years. We often see couples who have lived together for, say, one year and dated fo

10 weeks of Tier 1 Entrepreneur visa tips – Week 6 – Business plan is the key! And the keys to a successful business plan.

A business plan is a compulsory visa requirement for an initial entrepreneur application. It is also a key to a successful application and meeting the Genuine Entrepreneur Test. A business plan is a CV (some say “Resume”) of your business. It is a description of your idea, the actions you plan to make it work. The steps you have already taken, such as the market research, approaching potential clients, learning about UK taxes. Plus the steps you are planning in the future, such as organising marketing and employing staff. Finally, a financial plan: how you spend your capital of GBP 200,000, how much sales your business could achieve and profit it would eventually make. Like with your CV, you would like to highlight your skills and experience for the “job” (the job of running your business in the UK), Like with a CV, you should NOT make the most common mistake of downloading a standard template from the internet. The problem with that is the same as with most CVs these days. T

Top reasons permanent residence applications are rejected or refused

Some time ago, there was this headline  from the UK Visas and Immigration:  https://www.gov.uk/government/publications/apply-for-a-document-certifying-permanent-residence-or-permanent-residence-card-form-eea-pr/top-reasons-pr-applications-are-rejected-by-ukvi We thought it would make a good post for European / EEA citizens and their family members. The page offers a list of reasons, although they are quite generic, such as no signature on the form or no correct fee paid. So, we thought we would expand on the subject and add most common non-admin reasons, ie most common eligibility-related reasons. In descending order: #5 Students being unaware of the health insurance requirement,  which was – unfairly and unusually – applied retrospectively. This rule was added in June 2011, yet it refers to those studying even before that. #4 Believing (wrongly) that this application is based on the last 5 years , ie 5 years immediately prior to the date of application. It would have

Business plan writing service for a Tier 1 (Entrepreneur) visa - from a firm of experienced Immigration Entrepreneurs!

A  Business plan is a compulsory requirement for initial Entrepreneur visa applications.   Over the past several years we’ve been dealing with the Entrepreneur visa applications for our clients. As a part of each application, we have to read client’s business plan, ask to make changes and generally, to include the information relevant to the Entrepreneur visa rules as well as based on the questions a client may be asked at an interview (from our experience of clients’ visa interviews). Our experience allowed us to develop an approach to creating the business plans from a Tier 1 Entrepreneur visa point of view. Instead of using standard templates, we focus on what the visa officers want to see, i.e. on what a migrant will be required to do while holding this visa: investment of £50,000 or £200,000 and what your client is going to spend it on. For example, paying yourself a salary is not counted, yet it is very common for clients to do this.    Another example will be including a plan o

More detail provided on new settled status for EU citizens.

Today we had another update from the UK Government, which can be found here: https://www.gov.uk/government/news/more-detail-provided-on-new-settled-status-for-eu-citizens It says European citizens will have up to 2 years after the UK leaves the EU to apply for their settled status and applications will be considered using the commons sense rather than refused on a technicality. “At last!” we exclaim, as the technicalities have been quite favored by the Home Office when considering and often refusing the visa  applications.   There will be right to appeal an unsuccessful application. Another interesting point is the Statement saying the cost of applying under the new system will be no more than the cost of a British passport. It is not clarified, however, whether it is just the cost of a UK passport (passport book), which is only £72.50. Or the cost of the whole process of which the end result is UK passport, ie naturalization application (£1,282), biometrics (£19.20), ce
